Terms of Service

Welcome to Echo Baby. These Terms of Service ("Terms") are the agreement between you and Echo Baby for the use of our mobile app and the website at echobaby.app (together, the "Service"). Please read them carefully. By creating an account or using the Service, you agree to these Terms and to our Privacy Policy.

1. Acceptance and eligibility

By tapping "Get Started", creating an account, or otherwise using the Service, you confirm that you have read these Terms and agree to be bound by them. If you do not agree, please do not use the Service.

You must be at least 13 years old to use the Service (or 16 if you live in the European Economic Area or the United Kingdom). The Service is intended for parents, guardians, and caregivers tracking a baby's daily activities. By using the Service you confirm that you have the right to enter information about the baby in question.

If you are accepting these Terms on behalf of a household or organization, you confirm that you have authority to bind that household or organization to these Terms.

2. What Echo Baby is

Echo Baby helps you and the people you invite log feeds, sleep, diapers, reminders, and other activities for one or more babies. The data you log is synced to our servers so you can use it across devices and share it with members of your household.

Some features are free. Some require a paid subscription. We may add, change, or remove features over time. We will not remove features in a way that materially breaks paid subscriptions without giving you notice and a fair option to cancel.

3. Your account

You can use Echo Baby anonymously, or sign in with Google or Apple. You are responsible for keeping your account credentials secure and for activity that happens under your account. If you suspect someone else has gained access, change your password with the relevant identity provider and contact us so we can help secure the account.

You can delete your account at any time from Settings → Delete Account. See the Privacy Policy for what happens to your data on deletion.

4. Subscriptions, billing, and refunds

Echo Baby offers paid subscriptions that unlock additional features. The current prices, billing periods, and what is included are shown in the app before you subscribe.

4.1 Auto-renewal

Subscriptions are sold and billed by the Apple App Store (on iOS) and the Google Play Store (on Android). They renew automatically at the end of each billing period (for example, monthly or yearly) using the payment method on file with the store, unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.

4.2 Managing or cancelling

• iOS: Settings → [your name] → Subscriptions → Echo Baby.
• Android: Google Play Store → Profile icon → Payments and subscriptions → Subscriptions → Echo Baby.

Cancelling stops the next renewal. You keep access to paid features for the rest of the period you have already paid for.

4.3 Free trials

Some plans include a free trial. If you do not cancel before the trial ends, you will be charged the regular price.

4.4 Refunds

Because billing is handled by Apple or Google, refund requests must go through them under their respective policies: Apple refund policy · Google Play refund policy.

Where mandatory consumer protection law in your country gives you a right to cancel and receive a refund (for example, the EU 14-day right of withdrawal), that right is not affected by these Terms.

4.5 Price changes

We may change subscription prices in the future. If we do, we will notify you before the change takes effect, in line with App Store and Google Play requirements, and you will have the option to cancel before the new price applies.

5. Acceptable use

You agree not to:

• Use the Service in a way that violates any law or the rights of others.
• Try to access accounts, data, or systems that you are not authorised to access.
• Attempt to interfere with the Service, including by sending automated traffic, scraping, or attempting to overload our infrastructure.
• Reverse-engineer, decompile, or otherwise try to extract source code or model behaviour from the Service, except where the law expressly allows it.
• Use the Service to harass, abuse, or harm another person, including other members of your household.
• Misrepresent your identity, affiliation, or the source of any content you submit.
• Resell or commercially redistribute the Service without our written permission.

We may suspend or terminate access if we reasonably believe these rules have been broken.

6. Your content and data

You keep ownership of the information you enter into Echo Baby (baby profiles, activity logs, notes, photos, and so on). By using the Service, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, transmit, display, and back up that content for the purpose of running the Service for you and your household. This licence ends when you or we delete the content, except for backups that are automatically rotated as described in our Privacy Policy.

You are responsible for the content you enter. Do not enter information about anyone else's child unless you have a clear right to do so.

7. Our content

The Service itself, including the app, the website, our logo, our written content, and our visual design, is owned by us or our licensors and is protected by intellectual property laws. We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the Service for your own household's baby tracking, subject to these Terms. Nothing in these Terms transfers ownership of any of our intellectual property to you.

8. Third-party services

The Service relies on third-party platforms and services (for example, Apple, Google, RevenueCat, Sentry, Firebase Cloud Messaging, and the Apple and Google sign-in providers). Your use of those services is subject to their own terms and privacy policies. We are not responsible for outages, changes, or policy decisions of those providers.

9. Medical disclaimer

Information shown in the app, including any summaries, predictions, or insights derived from your logs, is for general informational purposes only. Always consult a paediatrician, doctor, midwife, or other qualified professional for any decision about your baby's health, feeding, sleep, or development. In an emergency, call your local emergency number.

Do not rely on push notifications, reminders, or any other feature of the Service for time-critical medical decisions.

10. Disclaimer of warranties

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we make no warranties, whether express, implied, statutory, or otherwise, including any warranty that the Service will be uninterrupted, error-free, secure, or that it will meet your specific requirements. We disclaim any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Some jurisdictions do not allow the exclusion of certain warranties. In those places, the exclusions above apply only to the extent permitted by local law.

11. Limitation of liability

To the fullest extent permitted by law, neither Echo Baby nor anyone working with us will be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill arising from your use of, or inability to use, the Service.

For any claim arising out of or related to the Service, our total liability is limited to the greater of (a) the amount you paid us for the Service in the 12 months before the event giving rise to the claim, or (b) US$50.

Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited, such as liability for death or personal injury caused by our negligence, or for fraud.

12. Indemnification

You agree to defend, indemnify, and hold harmless Echo Baby from any claim, liability, damage, or cost (including reasonable legal fees) arising from your misuse of the Service, your breach of these Terms, or your violation of any law or the rights of a third party.

13. Termination

You may stop using the Service at any time and delete your account from Settings. We may suspend or terminate your access if you materially breach these Terms, if we are required to by law, or if continuing to provide the Service to you would create a serious risk to us, to other users, or to a child whose data is being tracked.

Sections that by their nature should survive termination will do so, including sections 6 (your content licence to us, for backups in transit to deletion), 7 (our content), 9 (medical disclaimer), 10 (warranties), 11 (liability), 12 (indemnity), and 14 (governing law).

14. Governing law and disputes

These Terms are governed by the laws of England and Wales, without regard to conflict of law rules. Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the courts of England and Wales, except where mandatory local consumer protection law gives you the right to bring a claim in your country of residence.

Before starting any formal proceeding, please contact us so we can try to resolve the issue informally.

15. Changes to these Terms

We may update these Terms as the Service evolves. The "Effective" and "Last updated" dates at the top will reflect any change. For material changes, we will give prominent notice in the app before the new Terms take effect. If you keep using the Service after the effective date, you accept the updated Terms. If you do not agree, you can delete your account.
